54 years for woman caught possessing, selling shabu

DAVAO CITY -- A 20-year-old woman was sentenced to a total of 54 years in prison for possessing shabu (methamphetamine hydrochloride) and selling the drug to an undercover police officer in 2015.

In a judgement promulgated on the morning of January 7, 2019, Regional Trial Court (RTC) Branch 13 Judge Rowena Apao-Adlawan found Erica Fernandez guilty of possession and of selling drugs under the Comprehensive Dangerous Drugs Act of 2002.

In her 15-page judgement, Adlawan ruled that the prosecution was able to sufficiently prove Fernandez possessed one sachet of shabu weighing 1.3412 grams on the night of July 26, 2015 in front of a bar along Anda Street in Davao City.

The judge said the prosecution was also able to prove that Fernadez on the same day sold one sachet of shabu weighing 1.7569 grams worth P15,000 to Police Officer (PO)1 Sherwin Sammam of the San Pedro Police Station.

Adlawan imposed a penalty of 14 years to Fernandez for possessing shabu and reclusion perpetua or 40 years in prison for selling shabu/

The judge also directed Fernandez to pay a total of P800,000 to the government for her twin conviction.

Based on court records, the San Pedro Police conducted the buy bust operation after a confidential informant told them that the accused was selling shabu in the area.

Despite the chance to prove her innocence in court, the accused, a resident of Barangay 75-D, Davao City, did not present her defense.
