Court orders re-arrest of ‘Bikoy’ in perjury case

A Manila court on Wednesday ordered the issuance of a warrant of arrest against Peter “Bikoy” Advincula over his absence in the arraignment of his perjury case filed by three Free Legal Assistance Group lawyers over his claims linking them to an ouster plot against President Rodrigo Duterte.

“In view of the failure of the accused to appear in today’s hearing despite notice and upon motions of both the private prosecutor and public prosecutor, let the cash bail posted by accused [Advincula] be forfeited and confiscated in favor of the government,” Manila Metropolitan Trial Court Branch 17 Judge Karla Funtilan-Abugan said in her one-page order.

“Issue a warrant of arrest against him with bail at double the amount of the previous bail posted by the accused,” the judge also said.

Advincula is facing perjury case following the complaint of FLAG lawyers Chel Diokno, Erin Tañada and Theodore Te who accused him of falsely linking them to “Project Sodoma,” a supposed plot to boot out Duterte through the anonymous “Ang Totoong Narcolist” videos.

This stemmed from the Philippine National Police’s inciting to sedition complaint filed against the FLAG lawyers and several opposition figures. But state prosecutors dropped the complaint against them and only indicted Advicula, former Sen. Antonio Trillanes, and nine others.

The same court issued an arrest warrant against Advincula in January and set bail at P18,000. With the new warrant, bail is now at P36,000.

In the arraignment set on Wednesday, the court noted that Diokno, Tañada and Te, and their legal counsel Gregorio Tanaka Viterbo Jr., were all present.

Following Advincula’s failure to appear, Judge Funtilan-Abugan then set the arraignment and preliminary conference of the case on August 26, in the morning.
